Public offer
An individual entrepreneur, hereinafter referred to as the “Contractor,” invites any individual or legal entity, hereinafter referred to as the “Client,” to accept the terms of this agreement (hereinafter referred to as the “Offer”). Acceptance of the Offer is carried out by performing the actions provided for in this Agreement.
1. Terms and definitions
1.1. Offer – this document published on the Contractor’s website, defining the terms of service. The offer is a public offer addressed to an indefinite number of persons.
1.2. Acceptance – full and unconditional acceptance of the terms of the Offer by performing the actions specified in the Agreement. Acceptance is confirmed by payment for services.
1.3. The Contractor is an individual entrepreneur offering services under the Offer. The Contractor has all the necessary permits and licenses to provide the services provided for in this Agreement.
1.4. Client – an individual or legal entity who accepted the terms of the Offer and entered into an Agreement by acceptance. The Client undertakes to comply with all the terms of this Agreement and make timely payments for services rendered.
1.5. Services – services for the development, organization and conduct of excursions. Services include route planning, selection of tour guides and logistics.
1.6. Excursion is a service for organizing visits to sites of cultural, historical or natural significance. Excursions can be individual or group, depending on the Client’s preferences.
1.7. Excursionist – a person receiving excursion services. A tourist can be either an individual tourist or a member of a tourist group.
1.8. A guide is a person who accompanies the excursion and provides information about the objects visited. The guide has the appropriate qualifications and experience.
1.9. Accompanying person is a person who provides organizational and information services during the excursion. The accompanying person ensures the comfort and safety of the excursion group.
1.10. Excursion objects – historical, cultural, architectural monuments, natural sites, etc. Excursion objects are selected in accordance with the theme of the excursion and the preferences of the Client.
1.11. The excursion program is the sequence of visiting the excursion sites. The program includes a description of the route, visiting time and additional services.
1.12. Excursion route is the route followed by tourists, including visits to display objects. The route is developed taking into account convenience and safety for tourists.
2. General provisions
2.1. This Offer defines the rules for receiving services by the Client. The terms of the Offer are binding on both parties.
2.2. The offer is public and includes all essential terms of the Agreement. The offer does not require signature by the parties and is considered concluded from the moment of acceptance.
2.3. Acceptance of this Offer is the order of Services and payment for them. By making a payment, the Client confirms his acceptance of the terms of the Agreement.
2.4. The Agreement comes into force from the moment of its acceptance and is valid until the parties fully fulfill their obligations. The terms of the Agreement can only be changed by mutual agreement of the parties.
3. Subject of the Agreement
3.1. The Contractor provides the Services to the Client in accordance with the terms of this Agreement. Services are provided to the extent and under the conditions specified on the Contractor’s website.
3.2. The list of services and their descriptions are available on the Contractor’s website. The Client is obliged to read the description of services before ordering them.
3.3. The Contractor guarantees the availability of the necessary knowledge and skills to provide the Services. The Contractor undertakes to perform services efficiently and on time.
3.4. The Contractor has the right to involve third parties to fulfill the terms of the Agreement. The Contractor is responsible for the actions of third parties.
3.5. The Client accepts the terms of the Agreement in full, which is confirmed by payment for services. Partial acceptance of the terms of the Offer is not permitted.
4. Rights and obligations of the parties
4.1. The performer is obliged:
4.1.1. Provide services in accordance with the excursion program. The Contractor undertakes to comply with the stated deadlines and quality of services.
4.1.2. Ensure the quality of services provided. The Services must comply with the requirements established by this Agreement.
4.1.3. Inform the Client about the content of services. The client must receive complete and reliable information about the services provided.
4.1.4. Provide information support to the Client. The Contractor undertakes to respond to the Client’s requests in a timely manner.
4.1.5. Notify the Client of any changes in the terms of service. Changes to the terms of the Agreement are permitted only with the consent of the Client.
4.2. The performer has the right:
4.2.1. Cancel the application if payment is not received. In case of cancellation of the application, the advance payment made will be returned to the Client.
4.2.2. Terminate the Agreement in case of shortage of the group. In case of termination of the Agreement, the Client will be refunded the full cost of the services.
4.2.3. Send information to the Client. Information may include news, promotions and offers from the Contractor.
4.2.4. Engage third parties to provide services. The Contractor is responsible for the actions of third parties.
4.3. The client is obliged:
4.3.1. Pay for services on time. Payment is made in the manner and on the terms specified on the Contractor’s website.
4.3.2. Read information about the selected service on the website. The client is obliged to independently study the terms of service.
4.3.3. Provide reliable personal information. Personal data is used to place an order and contact the Client.
4.3.4. Arrive at the group meeting place on time. The Client’s lateness is not grounds for a refund.
4.3.5. Follow the rules of conduct and personal safety. The client is responsible for following the rules during the excursion.
4.4. The client has the right:
4.4.1. Receive paid services. The Contractor undertakes to provide services in full and on time.
4.4.2. Receive information about the terms and conditions of services. The Client has the right to request additional information from the Contractor.
4.4.3. Terminate the Agreement subject to the terms of the refund. Refunds are made in the manner prescribed by this Agreement.
5. Payment and return rules
5.1. Payment for tickets is carried out through the payment systems VISA, Mastercard. The Client can choose a convenient payment method on the Contractor’s website.
5.2. To pay, you must enter your payment card details. Payment is made through secure payment gateways.
5.3. The provider does not store payment card data. All transactions are secure and comply with international security standards.
5.4. Tickets can be returned:
5.4.1. One week before the event with a 50% refund. The customer must contact support to process the return.
5.4.2. No refunds will be issued once the event has started. This condition applies to all types of tickets and services.
6. Personal data
6.1. The client consents to the processing of personal data. Consent is voluntary and informed.
6.2. Data processing includes storage, processing and use for the execution of the Agreement. The data is used solely for the provision of services and communication with the Client.
6.3. The Contractor uses the data to inform about competitions, promotions and news. The client can unsubscribe from receiving the newsletter at any time.
6.4. The client may refuse to receive notifications. To refuse, you must use the appropriate function on the website or contact support.
7. Responsibility of the parties
7.1. The Contractor is not responsible for the Client’s errors when providing data. The client is obliged to provide accurate information.
7.2. The Contractor is not responsible for delays caused by banks or payment systems. In case of delays, the Client must contact his bank.
7.3. The Client is responsible for violating the terms of the Agreement. In case of violation of the terms of the Agreement, the Contractor has the right to terminate the Agreement unilaterally.
8. Dispute resolution
8.1. All disputes are resolved through negotiations. The parties undertake to do everything
possible measures for the peaceful settlement of disputes.
8.2. If it is impossible to resolve disputes through negotiations, they are subject to consideration in court. The place for consideration of disputes is determined by the location of the Contractor.
9. Changes in the terms of the Agreement
9.1. The agreement is valid until the parties fully fulfill their obligations. The terms of the Agreement can only be changed by mutual agreement of the parties.
9.2. Changes to the Agreement are made by agreement of the parties or based on notification from the Client. Notice must be given in writing and confirmed by receipt.
